Trump Administration Abandons Appeal of Court Ruling That Blocked Anti-DEI School & College Funding Threats

In January 2026, the U.S. Department of Education withdrew its appeal of a federal district court decision that invalidated the controversial February 14, 2025 “Dear Colleague Letter” (DCL). The original judgment found that the Department exceeded its legal authority by attempting to regulate campus and classroom speech without proper process and in ways that were unconstitutionally vague, including through threats tied to federal funding.

This development means that the court’s findings, which protect lawful diversity, equity, inclusion, and belonging efforts at K-12 schools and higher education institutions, will stand as decided. Importantly, the ruling confirms that the federal government cannot lawfully use funding threats to limit educational institutions’ ability to advance fairness and opportunity.

TENTATIVE DATE(s):

July 24–25, 2026

Higher education is facing unprecedented constraints—and this moment calls for collective action. Join TADOHE’s sixth annual summit to convene with educators, practitioners, and advocates committed to protecting equity, academic freedom, and access across Texas and beyond.

This two-day, teach-in–style convening will provide practical tools, shared language, and actionable strategies to navigate shifting policies, respond to anti-DEI mandates, and prepare for the upcoming 90th Texas Legislative Session. Together, we will strengthen cross-sector collaboration, center lived experience, and build sustainable, community-driven approaches to higher education leadership.

Save the date. Bring your voice. Be part of the movement.
