All persons and business entities engaged in the business of selling goods and services from mobile units may conduct business if they comply with this article.

It shall be unlawful for any person or business entity to engage in the business of selling goods and services from mobile units unless they have first obtained a permit from the city or its designee.

The city or its designee shall have exclusive right to designate the number and location of mobile vending units operating within the city limits.

All persons and business entities seeking a permit from the city to engage in the business of selling goods and services from mobile vending units must comply with Chapter 437 and all applicable provisions of the Texas Health and Safety Code.

All persons or business entities seeking a permit must complete the permit application process. Applications may be requested at the city hall.

Any vendors granted a vending permit under this article shall pay an annual permit fee of $250.00 (two hundred fifty dollars and zero cents). Any vendor granted a temporary vending permit for special events shall pay a fee of $100.00 (one hundred dollars and zero cents) for each day of vending permitted.

The penalty for violating any provision this article shall be a fine in accordance with the general penalty provision set forth in Section 1.109 of this code for each offense together with revocation or suspension of the vendor’s permit. Each day of violation shall be deemed a separate offense.

In addition to the penalties contained herein, any permit issued under this article may be suspended or revoked for any of the following reasons:
(1)
Fraud, misrepresentation or knowingly making a false statement in the application for the permit;
(2)
Fraud, misrepresentation or knowingly false statement in the course of carrying on the business of vending;
(3)
Conducting the business of vending in such a manner contrary to the conditions of the permit;
(4)
Cancellation of health department authorization for a food or beverage; or
(5)
Conducting the business of vending in such a manner as to create a public nuisance, cause of breach of the peace, constitute a danger of the public health, safety, welfare or morals or interfere with the rights of abutting property owners.
