The city hereby approves and adopts the drought contingency and emergency water plan for the city. The city council authorizes the implementation and the enforcement of the plan according to the procedures set forth in the adopted plan or as included in this article.

(a) 
The mayor is hereby designated as the city’s official, responsible for the overall implementation and enforcement of the drought plan and for reporting annually, to the state water development board. The mayor may delegate to the director of public works and to the manager of utilities the daily management and administration of the drought contingency and emergency water plan.
(b) 
This article applies to citizens and to all customer users of the city potable water supply and distribution service, including but not limited to, single-family or duplex residences, apartments, mobile homes and/or trailer parks, places of business, industries, public facilities, institutional facilities, schools, educational facilities, churches, recreation facilities, hospitals and clinics, and structures and facilities of any kind that use and are connected to the city water supply and distribution system.

As used in this article, the following terms shall have meanings as set out below, unless the context clearly indicates that another meaning is intended:
Critical Water Restriction Period.
A period of time during a water emergency period which begins when:
(1) 
The manager of utilities has certified to the mayor that water pressures within the city’s water distribution system have dropped to such a level that the health and safety of the city are imperiled by such low pressures.
(2) 
Based upon such certificate, the mayor has declared the existence of a critical water restriction period by filing a written declaration to that effect with the city secretary.
(3) 
A critical water restriction period ends when the mayor has found that the pressure conditions, leading to the declaration of the period, no longer exist and has filed a written declaration to that effect with the city secretary.
System Constraints.
The limits established for the city’s water supply and distribution system shall be eighty (80) percent of the operating capacity of the water well(s) given in gallons per day (GPD) and a minimum allowable water pressure of thirty (30) pounds per square inch (psi) throughout the system.

The drought contingency and water emergency plan.
To Discharge Water.
To allow, permit or cause water to be released through a faucet, hose or sprinkler or similar pressurized source. The pouring, releasing or sprinkling of water into or from a can, bucket, tank or similar container not connected to the city water distribution system shall not be a discharge of water for the purposes of this article.
Water.
Treated water delivered directly to the ultimate retail purchaser thereof, through any portion of the water distribution systems owned by the city.
Water Emergency Period.
A period of time which begins when the mayor:
(1) 
Has found that one million, one hundred seven thousand (1,107,000) gallons of water, or more, have been pumped into the city’s distribution system during any seventy-two-hour period; and
(2) 
Has declared the existence of a water emergency by filing a written declaration to that effect with the city secretary.

The city obtains its potable water supply from the coastal plain aquifer. This groundwater source is adequate now and for the foreseeable future. The present well production and storage capacity are limited. The present well is rated at 400 gallons per minute (GPM). The following guidelines
are hereby established for the purpose of establishing system constraints for the city’s water supply, storage, treatment and distribution systems:
(1) 
Well Capacity.
Use 80% of well’s capacity or 460,000 Gallon per Day (GPD).
(2) 
Minimum Allowable Water Pressure.
Shall be 30 psi.

With the maximum allowable condition set at 80% of well capacity of 460,000 GPD, the following triggering limits are hereby established:
(1) 
Mild Condition.
(A) 
80% of maximum allowable condition or 369,000 GPD.
(B) 
Water Pressure:
40 pounds per square inch (psi)
(2) 
Serious Condition.
(A) 
Water usage at 90% of maximum allowable condition or 414,000 GPD.
(B) 
Water Pressure: 40 psi
(3) 
Critical Condition.
(A) 
Water usage at 440,000 GPD and reaching maximum allowable condition of 460,000 GPD.
(B) 
Limiting water pressure to 30 psi.

The following actions shall be taken by the city, but shall not be limited to these actions only, when the above stated trigger conditions are reached. The emergency management program is as set forth in the drought contingency and emergency water plan and shall be included as a part of this article.

Any person, firm or corporation or agent thereof who shall violate a provision of this article, or fail to comply therewith or with any of the provisions thereof, shall be guilty of a misdemeanor. Each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this article is committed or continued, and upon conviction in the court of jurisdiction for any such violation, such person shall be punished by a fine in accordance with the general penalty provision set forth in Section 1.109 of this code.

The person, firm or corporation agent thereof, who has been found guilty of violation of a provision of this article, may appeal the decision of the court of jurisdiction.
